Is my switchblade illegal?
I live in New York City and I collect knives every now and then, and recently a folding knife I bought broke a piece off when it hit against a wall (don't ask how). Anyway, that piece was the part that resists pressure and makes it impossible to open without the thumb stud.
The blade isn't swinging out at random or anything, however, if i swing the knife properly and with enough force while its closed the blade comes out.
Did I turn my knife into an illegal one cause it can open without the need for the thumb stud, or does the whole "gravity knife" ban only apply if the blade can simply fall out of concealment by holding it?
NY Penal Law section 265.00 defines two types of knives as follows:
4. "Switchblade knife" means any knife which has a blade which opens
automatically by hand pressure applied to a button, spring or other
device in the handle of the knife.
5. "Gravity knife" means any knife which has a blade which is released
from the handle or sheath thereof by the force of gravity or the
application of centrifugal force which, when released, is locked in
place by means of a button, spring, lever or other device.
Mere possession of either type of knife in NY is a Class A Misdemeanor under section 265.01.
Class A misdemeanors are punishable by up to one year in jail.
